Terms and Conditions of Sale: This Agreement contains the terms and conditions that apply to your purchase from the entity named on the invoice ("EK Water Blocks") that will be provided to you ("Customer") on orders for advanced computer cooling solutions, computer systems and/or related products sold in the Slovenia. By accepting delivery of the advanced computer cooling solutions, computer systems and/or other products described on that invoice. Customer agrees to be bound by and accepts these terms and conditions. These terms and conditions are subject to change without prior written notice at any time, in sole discretion of EK Water Blocks. All items purchased at EK Water Blocks are to be used at your own risk. When used properly, all EK Water Blocks products are absolutely safe. Damage to computer components and possible bodily harm can occur if a product is used improperly. EK Water Blocks assumes no liability whatsoever, expressed or implied for the use of these products.
We do not guarantee compatibility. Disclaimer and Limitation of Liability as to Products Sold Limited warranty
EK Water Blocks issues a two-years warranty on all their products covering manufacturing and material defects on condition that the products are used in normal fashion. The warranty shall apply for two years from the moment EK Water Blocks sells the product concerned (to the first buyer).
Within the period of the warranty, and in accordance with the terms of the warranty, EK Water Blocks will undertake to replace or repair all defective components which have been used in normal fashion.
However, the warranty is subject to the limitations and exceptions outlined below. Conditions and limitations:
EK Water Blocks's liability shall be limited to repair or replacement of components which are defective owing to manufacturing or material defects.
EK Water Blocks assumess no other liability than this, not even liability for indirect losses caused by the defect concerned, including operating losses, loss of profits, or damage caused to real property or moveable property occurring while the product concerned is the possession of the Buyer.
The Buyer alone shall bear the responsibility and risk involved as to whether the products are suitable for the application intended. EK Water Blocks assumes no liability in this connection.
EK Water Blocks assumes no liability for defects which occur due to use of their products for purposes for which they are not intended, or for defects which occur owing to incorrect installation, corrosion, ultraviolet degradation, lack of maintenance, or any alteration or repair of the product carried out incorrectly by the Buyer. Finally, EK Water Blocks assumes no liability for normal wear and tear, or for depreciation of value.
Nor do EK Water Blocks assume any liability for service carried out by anyone other than authorised representatives of EK Water Blocks, unless such service is carried out pursuant to guidelines laid down by EK Water Blocks and in accordance with good craftsmanship.
The Buyer shall inform EK Water Blocks in writing of any defects with no undue delay once defects have been registered. Products being dealt with under the warranty shall be returned to EK Water Blocks for repair unless any other agreement has been reached in writing
EK Water Blocks shall not cover costs incurred by the Buyer in connection with the transport or wages involved in a warranty case. Such costs shall be met by the Buyer in full.
On all water cooling and related products, including accessories all sales are final unless otherwise noted. Defective items will be replaced. See Return Policies for more info.
Please Note: For security purposes, orders totaling one thousand euros or more, may require some forms of identification before processing.
We reserve the right to cancel unfulfilled orders at any time or request payment in advance through money order or certified bank check.
Pictures are for illustration purposes only. Typographical Errors In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, EK Water Blocks shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. We are not responsible for typographical errors, even if an invoice was issued in error. EK Water Blocks shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, EK Water Blocks shall immediately issue a credit to your credit card account in the amount of the charge. Sales Taxes EK Water Blocks will not apply tax or customs charges. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state or Country. Payment Terms Terms of payment are within EK Water Blocks sole discretion, and unless otherwise agreed to by EK Water Blocks. Payment must be received by prior to EK Water Blocks acceptance of an order. Payment for the products will be made by credit card, wire transfer, or some other prearranged payment method unless credit terms have been agreed to by EK Water Blocks. Invoices are due and payable within the time period noted by EK Water Blocks based on the purchase, measured from the date of the invoice. EK Water Blocks may invoice parts of an order separately. Orders are not binding upon EK Water Blocks until accepted by EK Water Blocks. Any quotations given by EK Water Blocks will be valid for the period stated on the quotation. Customer agrees to pay interest on all past-due sums at the highest rate allowed by law. Return and Exchange Policy Damaged Items: All shipping packages are fully insured. If you receive a damaged package, you must notify us immediately my e-mail. Sending back damaged merchandise voids the shipping insurance and no credit will be given. Damaged packages must be held for seven days with original packaging for FEDEX inspection. EK Water Blocks systems and parts that are purchased directly from EK Water Blocks by an end-user customer may be returned by Customer in accordance with EK Water Blocks "Return Policy" in effect on the date of the invoice. Products returned for credit must be received within 30 days of invoice date and a 15% restocking fee will apply. Product must be returned within 30 days. Systems are returnable for repair or replacement only. EK Water Blocks will not assess a restocking fee for defective products. A qualified EK Water Blocks technician will test each returned product for defects.
Warranty is void if a product has been tampered with in a way in which it was not designed. Misuse, modification, handling damage (i.e. dropping) will void warranty. Returned items must be in like new condition. Returns will not be accepted without an authorized RMA number, which is valid for 14 days after being issued. Customers will be responsible for return shipping charges on merchandise. The customer is responsible for shipping the product back. This is analogous to paying for gas to drive a product back to a store you bought from to return it. Please ship using a carrier that provides a tracking number and proof of delivery. We recommend UPS or Fedex. EK Water Blocks will not be responsible for items lost by the carrier. Valid proof of delivery must include the receipt signature of an authorized EK Water Blocks employee.
Exchanges From time to time, EK Water Blocks may, in its sole discretion, exchange products or portions of a product. Any exchanges will be made in accordance with EK Water Blocks exchange policies in effect on the date of the exchange. SHIPPING POLICY Important Note: All orders require 1-3 Business Days processing time before ship. EK Water Blocks does not guarantee same day shipping. EK Water Blocks does not process orders during weekends.
Shipping Charges EK Water Blocks ships each order via Slovenian Post Service Company. Rates are automatically calculated by Online Shipping Calculator by accordance of weight.
Shipping charges will be added to your order upon check out. Since shipping cost is based on region, charges cannot be figured until the bill to and ship to portions of the order form are filled out. Shipping information is displayed immediately following the bill to and ship to information in the check out process. This allows you to view shipping fees before any charges are placed to your credit card. By default UPS lists the highest priced shipping method so make sure to select your preferred method from the drop down list. Shipping charges are not included in the price of the item.
Shipping time is not guaranteed; shipping cost is also not guaranteed.
We are sorry, but we can not refund the shipping charges for weather related delays.
EK Water Blocks does not take responsibility for delayed arrivals on packages shipped to rural areas.
EK Water Blocks does not take responsibility for delayed arrivals due to closed or delayed airport activity. International Shipping EK Water Blocks can provide international shipping. Paypal money transfer is the preferred method for international orders. International orders may require some forms of identification before processing. EK Water Blocks require payment before shipping. Unless otherwise noted all international shipments will be made via Slovenian Post Service Company International Priority or Economy. If we the Slovenian Post service can not ship to the country or area that you reside in, we may not be able process your order, in which case we cancel your order.
Overseas orders may be subject to import tax. We do not charge for this tax, so the customer will have to take care of it separately. You are responsible for, if any customs, duties, taxes, or additional fees your country or the shipping company charges to import these items. Once the package leaves the borders of the Slovenia there is very little we can do to track the package. We are not responsible for any package that is damaged or lost due to another country's customs or postal service. Shipping time is not guaranteed; shipping cost is also not guaranteed. If the item is lost, damaged, or delayed by the shipping service - we are not responsible. No refunds, credits, or replacements will be given by EK Water Blocks.
